A BILL supplementing and amending chapter thirteen, acts of the
Legislature, regular session, two thousand four, known as the
budget bill, all supplementing and amending the appropriation
for the fiscal year ending the thirtieth day of June, two
thousand five.
Be it enacted by the Legislature of West Virginia:
That chapter thirteen, acts of the Legislature, regular
session, two thousand four, known as the budget bill, be
supplemented and amended by creating Title II, section eight-a to
read as follows:
Sec. 8a. Appropriations from general revenue surplus
accrued.-The following items are hereby appropriated from the state
fund, general revenue, and are to be available for expenditure
during the fiscal year two thousand five out of surplus funds only,
accrued from the fiscal year ending the thirtieth day of June, two
thousand four, subject to the terms and conditions set forth in this section.
It is the intent and mandate of the Legislature that the
following appropriations be payable only from surplus accrued as of
the thirty-first day of July, two thousand four, from the fiscal
year ending the thirtieth day of June, two thousand four.
In the event that surplus revenues available on the thirty-
first day of July, two thousand four, are not sufficient to meet
all the appropriations made pursuant to this section, then the
appropriations shall be made to the extent that surplus funds are
available as of the date mandated and shall be allocated first to
provide the necessary funds to meet the first appropriation of this
section; next, to provide the funds necessary for the second
appropriation of this section; and subsequently to provide the
funds necessary for each appropriation in succession before any
funds are provided for the next subsequent appropriation.
